Charges

The charges against Mr Peter Campbell were:

Charge 1

Failing to comply with CILEx and CILEx Regulation rules and bye-laws contrary to Principle 4 of the CILEx Code of Conduct 2010.

The particulars to charge one were that Peter Campbell failed to complete Continuing Professional Development during the required period of 1 October 2013 to 30 September 2014.

Charge 2

Failing to comply with CILEx and CILEx Regulation rules and bye-laws contrary to Principle 4 of the CILEx Code of Conduct 2010.

The particulars to charge two were that Peter Campbell failed to log Continuing Professional Development during the required period of 1 October 2013 to 30 September 2014.

Charge 3

Failing to comply with regulatory obligations and deal with regulators and ombudsmen openly, promptly and co-operatively and/or failing to comply with and respond to reasonable enquiries made by an Investigator and failure to do so may be treated as misconduct contrary to Principle 4 of the CILEx Code of Conduct 2015 and Rule 15 (6) of the CILEx Investigation, Disciplinary and Appeal Rules 2015.     

The particulars to charge three were that Peter Campbell failed to acknowledge or reply to communications from his regulator, CILEx Regulation.

Charge 4

Failing to maintain high standards of professional and personal conduct; and/ or behave with honesty and integrity contrary to Principle 2 and/ or 3 (respectively) of the CILEx Code of Conduct 2015.

The particulars to charge four were that on 4 May 2016 Peter Campbell was convicted by the Southwark Crown Court of providing unregulated immigration advice and services between March 2012 and January 2016 contrary to section 91 of the Immigration and Asylum Act 1999. 

On 1 June 2016 at Southwark Crown Court Peter Campbell was sentenced to 8 months’ imprisonment suspended for 24 months and was required to undertake 200 hours of unpaid work before 31 May 2017 and attend probation for 12 months.

Outcome

The Tribunal found all charges proved.

Sanction

The Disciplinary Tribunal ordered that Mr Campbell be excluded from CILEx membership for a period of 5 years with no automatic reinstatement. Mr Campbell was ordered to pay costs.
