Charges

The charges against Ross Cantor were:

  1. Failing to uphold the rule of law and the impartial administration of justice contrary to Principle 1 of the CILEx Code of Conduct 2015; and/ or
  2. Failing to maintain high standards of professional and personal conduct and justify public trust in you, your profession and the provision of legal services contrary to Principle 1 of the CILEx Code of Conduct 2015; and/ or
  3. Failing to act in the best interest of a client contrary to Principle 5 of the Code of Conduct. 

The particulars of the charges were that Ross Cantor, a Graduate member of CILEx, carrying on a business under the style “RSC Legal Services” from 88A Rhydypenau Road, Cyncoed, Cardiff did, on and after 24 November 2015, carry out a Reserved Legal Activity (within the meaning of the Legal Services Act 2007) namely the conduct of litigation in that:- 
  1. On or about 24 November 2015 Ross Cantor sent for issue in the County Court a Claim which bore his name and address for service and was duly issued on 11 December 2015 with Claim No B54YP220; and/or 
  2. In the same proceedings on or about 15 January 2016 Ross Cantor submitted to the Court a Directions Questionnaire bearing his name and signature as the Claimant’s legal representative; and/or 
  3. In the same proceedings on or about 4 March 2016 Ross Cantor completed and submitted to the Court an Application Notice bearing his name and signature as the Claimant’s Legal Representative, and containing a signed Statement of Truth on the Claimant’s behalf; and/or 
  4. In the same proceedings on or about 4 March 2016 Ross Cantor completed, signed and filed at the Court a witness statement in support of the said Application, purporting to be the Claimant’s legal representative; and/or
  5. In the same proceedings on or about 6 May 2016 Ross Cantor posted by way of service upon the Defendants a copy of a witness statement in support of the said Application.

Outcome

The Tribunal found the charge proven.

Sanctions

The Disciplinary Tribunal decided to exclude Ross Cantor from CILEx Membership for a period of 1 year. Costs were ordered.
