The charge against Mrs Katherine Pearson of Exeter was that she engaged in conduct unbefitting to ILEX or likely to bring ILEX or its members into disrepute contrary to the Code of Conduct.
The particulars to this charge were that:
An order was made against Mrs Pearson under s43 Solicitors Act 1974 that no solicitor shall employ or remunerate her without the consent of the Law Society.
Mrs Pearson misappropriated client funds in that she transferred monies from a client account of a client for whom she was acting during the course of her employment by obtaining cheques for which no payments were due.
The charge was found proved.
The Tribunal decided that Mrs Pearson should be excluded from membership of ILEX indefinitely.
