Data Release to Comparison Websites
The Legal Services Board and Legal Services Consumer Panel requirement
The Legal Services Consumer Panel (the Consumer Panel) and the Legal Services Board (LSB) asked the legal regulators to publish data relating to their regulated community in a readily reusable format. The aim is that comparison websites can access and use the data.
Action being taken by CILEx Regulation to release data
We decided that it is important for data relating to our Authorised Entities to be provided to consumers by releasing it to comparison websites.
This will also ensure that our Authorised Entities have the same opportunities as those from other parts of the legal sector to raise their public profile and their work in the specialist areas of law in which they are authorised.
Where will the released data be located?
The data is published in an Excel spreadsheet located on the consumer section of the CILEx Regulation website.
In what format is the data released?
The data is set out in an Excel spreadsheet. Information is provided to indicate how up to date the data is.
What data is released about Authorised Entities?
Data about each Authorised Entity is automatically released onto the CILEx Regulation website in spreadsheet format.
The data that is released about an Authorised Entity is:
- entity name
- business address as it appears in the CILEx Authorised Entity Directory
- name of Approved Manager(s), if consent is given
- name of Compliance Manager(s), if consent is given
- confirmation that the entity is regulated by CILEx Regulation
- the number of authorised persons
- the area(s) of law in which the entity is authorised.
What data is released about individual Approved Managers or Compliance Managers?
An individual, who is an Approved Manager and or a Compliance Manager, has the option to consent/not consent to inclusion of their individual data on the entity data spreadsheet. An individual’s data which is included on the entity spreadsheet, if they consent, is the individual’s name and salutation.
Giving or withdrawing consent to data release by individuals
Approved Manager and Compliance Manager who are not Chartered Legal Executives or CILEx Practitioners
Individuals, who are Approved Managers or Compliance Managers, but are not Chartered Legal Executives or CILEx Practitioners, may consent to release of their individual data when completing their authorisation application forms. They may subsequently withdraw consent or give consent (if originally not consented), on annual return forms or by contacting CILEx Regulation directly.
Approved Manager and Compliance Manager who are Chartered Legal Executives or CILEx Practitioners
Individuals, who are Approved Managers or Compliance Managers and who are Chartered Legal Executives or CILEx Practitioners, may consent to release of their individual data when completing their authorisation application forms. They may subsequently withdraw consent or give consent (if originally not consented), on annual return forms or by contacting CILEx Regulation directly. They can also record their consent to release of their data in their personal myCILEx account.
The most up-to-date indication to consent/not consent to release of data by an individual (whether communicated to us in a form, directly or recorded in a personal myCILEx account) will be recorded by us, or remain recorded, in their personal myCILEx account. The decision to consent/not consent to release of data recorded in an individual's personal account will determine whether an individual's data is included on the entity spreadsheet.
Change in consent to release of an individual’s data
This information applies to an Approved Manager or Compliance Manager who changes their consent to the release of their individual data. The individual’s data will not immediately be removed from, or added to, the entity spreadsheet which is published on our website. The data will be excluded from, or added to, the entity spreadsheet which is next published on our website following notification of the change to us.
Will disciplinary data be included?
Disciplinary information will not be released in the Excel spreadsheet format. Comparison websites are asked to include a statement to inform the public that they can view disciplinary records about Authorised Entities and their managers on the CILEx Regulation website. The statements will include details of unsuccessful appeals against disciplinary decisions, where publication has been ordered, and is published on the CILEx Regulation website.
How frequently will the data be updated?
The data on the spreadsheet will be updated regularly; however, various data may be updated at different time intervals.
Where will the data be taken from?
Data about an Authorised Entity, Approved Manager and Compliance Manager will be taken from data returns, such as application and annual return forms, and from data provided directly to CILEx Regulation.
Data about Approved Managers or Compliance Managers who are Chartered Legal Executives or CILEx Practitioners will also be taken from information provided through their personal myCILEx account.
It is important that the information provided to CILEx and CILEx Regulation is accurate and kept up to date.
