We are the regulatory body for Associate Prosecutors. Associate Prosecutors are employees of the Crown Prosecution Service (CPS). They are registered in the Associate Prosecutor membership grade with CILEx.
The CPS and CILEx have an agreement setting out arrangements for the independent regulation of Associate Prosecutor employees of the CPS.
Associate Prosecutors are authorised by CILEx to exercise rights of audience and rights to conduct litigation.
There are two levels of Associate Prosecutor, Level 1 and Level 2. Those applying to become an Associate Prosecutor undergo a selection and training programme before being authorised to exercise the rights. The rights of audience and rights to conduct litigation vary for each level.
The rights granted to Associate Prosecutors include the right to review and present straightforward cases in the Magistrates' Courts and at Level 2 to undertake trials involving non-imprisonable summary offences. Full details of the rights available to Associate Prosecutors at Levels 1 and 2 are contained in the Associate Prosecutor Rights of Audience and Litigation Certification Rules.
Our qualification scheme provides external regulation and oversight of the training and qualification scheme for Associate Prosecutors.
